Elon Musk’s companies withdraw Apple antitrust lawsuit while OpenAI case continues

Elon Musk’s ventures, including xAI and X (SpaceXAI), have voluntarily dismissed their antitrust lawsuit against Apple, according to a report citing a new filing. The legal action, which had accused the iPhone maker of anticompetitive behavior in its App Store rankings and practices, is no longer moving forward — but a parallel case targeting OpenAI remains active.

The dropped suit against Apple had been part of a broader legal push by Musk’s companies challenging how major AI and platform players operate. While the Apple complaint has been shelved, Musk’s OpenAI litigation — rooted in the ongoing dispute over the direction and governance of the artificial intelligence company he co-founded — continues in court.

Apple, meanwhile, showed modest movement in trading following the news. Shares of Apple changed hands at $334.87, up 0.7% from the prior close of $332.55, valuing the consumer electronics giant at roughly $4.6 trillion. The Cupertino-based company, whose business spans the iPhone, Mac, iPad, and wearables, has faced a series of antitrust challenges in the US and abroad in recent years, making the withdrawal of this particular suit a notable de-escalation.

The dismissal removes one legal overhang for Apple, which has been contending with regulatory scrutiny of its App Store policies on multiple fronts. For Musk’s camp, retaining the OpenAI case keeps pressure on the AI company at a time when competition among frontier AI developers has intensified, with xAI positioning its Grok models as a challenger in the market.

The reasons behind the decision to drop the Apple case were not immediately detailed in the filing, and it remains unclear whether the claims could be refiled or resolved through other means. Legal observers will be looking for further court documents to clarify the parties’ positions.

What to watch

  • Further court filings clarifying why the Apple suit was dismissed and whether similar claims could resurface.
  • Procedural developments in the ongoing Musk–OpenAI litigation, including upcoming hearings or rulings.
  • Apple’s next quarterly earnings report and any commentary on App Store policy and regulatory matters.
  • Competitive updates from xAI regarding Grok model releases and platform integrations.
